DISTANCE SALES AGREEMENT

This Distance Sales Agreement ("Agreement") is made electronically between the following parties in accordance with Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts (RG: 27.11.2014 / 29188).

BUYER (CUSTOMER)

The individual or entity purchasing goods or services through leylichulagova.com ("Buyer"). Buyer details are based on the information provided at checkout.

 

By placing an order through the website, the Buyer accepts this Agreement electronically and acknowledges that they are legally obligated to pay for the products ordered.

 

2. SUBJECT OF THE AGREEMENT

This Agreement regulates the rights and obligations of the Buyer and the Seller regarding the sale, payment, delivery, and return of the products offered on leylichulagova.com.

This Agreement is subject to Law No. 6502 on Consumer Protection and the Distance Contracts Regulation.

 

3. PRODUCT(S) AND ORDER DETAILS

Shipping Fees

Total Order Cost

will be displayed in the order confirmation email and on the checkout page before payment.

 

Prices listed on leylichulagova.com are valid until updated or changed by the Seller.

 

4. DELIVERY TERMS

4.1 Shipping & Delivery Time

Orders will be processed within 1-3 business days after payment confirmation.

 

Estimated delivery time:

 

Domestic (Turkey): 3-7 business days

International: 7-14 business days (customs delays may affect this timeframe).

If an order cannot be delivered within 30 days, the Buyer has the right to cancel the order for a full refund.

 

4.2 Shipping Costs

International Orders: Calculated at checkout.

The Buyer is responsible for shipping fees unless otherwise stated in the product description or promotional campaign.

4.3 Risk of Loss & Damage

The risk of loss or damage transfers to the Buyer once the product is handed over to the courier.

If a product is visibly damaged upon delivery, the Buyer must request a damage report from the courier and contact the Seller within 48 hours.

5. PAYMENT TERMS

Payments can be made by credit card, debit card, or other methods available on the website.

All transactions are processed securely, and the Seller does not store credit card details.

6. RETURN & EXCHANGE POLICY

6.1 Right of Withdrawal (Not Applicable)

In accordance with Article 15(1)(b) of the Turkish Regulation on Distance Contracts, the right of withdrawal does not apply to products that are custom-made, produced based on personal preferences, or sold as part of a limited edition designer collection. All products offered on leylichulagova.com are considered unique or made-to-order and are therefore non-returnable and non-refundable unless the item is defective, damaged, or incorrect.

 

6.2 Non-Returnable Items:

All items sold on leylichulagova.com are either custom-made or part of a limited designer collection and are strictly non-returnable unless proven defective or incorrect.

Personalized or custom-made products.

6.3 Returning Defective, Incorrect, or Damaged Products

If the Buyer receives a defective, incorrect, or damaged product, they must:

Notify the Seller within 48 hours with photos/videos of the issue.

Return the item within 7 days (the Seller will cover return shipping).

If the issue is not caused by the Seller or shipping company, the return may be denied.

 

6.4 Exchange Policy

Due to the limited and exclusive nature of our products, exchanges are only possible if the item is defective or incorrect and subject to availability.

If the item is no longer available, the Buyer may opt for store credit.

6.5 Refund Terms

Refunds are only issued in cases where the product is proven to be defective or incorrect.
Shipping fees are non-refundable unless the return is due to an error by the Seller.

7. FORCE MAJEURE

The Seller is not responsible for delays or failures caused by:

 

Natural disasters (earthquakes, floods, fires).

Government actions, regulations, or restrictions.

Strikes, labor disputes, or supplier disruptions.

Cyberattacks, internet failures, or system breakdowns.

If a delay occurs due to force majeure, the Buyer has the right to cancel the order for a full refund.

 

8. DISPUTE RESOLUTION & APPLICABLE LAW

This Agreement is governed by Turkish law.

In case of disputes, the Buyer may apply to:

Consumer Arbitration Committees for claims under the monetary limits set by the Turkish Ministry of Trade.

Consumer Courts for disputes exceeding the arbitration committee limits.

9. AMENDMENTS TO THE AGREEMENT

The Seller reserves the right to update this Agreement at any time.

The revised version will be posted on the Website, and continued use of our services constitutes acceptance of the new terms.
